If someone sends a legal fleet and the other guy sends nothing, first 
guy wins.
If someone sends an illegal fleet and the other guy sends nothing, first 
guy *still* wins.

If someone sends a legal fleet and the other guy sends a legal fleet, 
the winner is the one who didn't retreat
If someone sends an illegal fleet and the other guy sends a legal fleet, 
the guy with the legal fleet is the winner if the first guy can't make a 
legal fleet.

If someone sends an illegal fleet and the other guy sends an illegal 
fleet, then the Moderator smacks them both for being [expletive] silly. 
If it goes on, the smackings will have creative consequences. >hint< >hint<
